PHTM has been contacted steadily since the penalty level change for the use of hand held mobile phones in vehicles came in on March 1st.
There has been quite a high degree of confusion surrounding this issue; therefore we contacted the Department for Transport for clarification and guidance.
Following is their response; they stress that, as always, the DfT does not provide legal advice. For any future situations that arise as a result of these regulations, it is up to the police and the courts to decide the outcome.
The important message here is that if the use of any in-car equipment affects driving performance, the police may prosecute the driver for not being in proper control of the vehicle.
